Public offer of an online confectionery store1. General Provisions
1.1. This document constitutes an official offer (public offer) by Individual Entrepreneur Ekaterina Evgenyevna Kolbina, TIN 231 489 941 905 / OGRNIP 325 237 500 261 907, hereinafter referred to as the "Seller", addressed to any legally capable individual, to conclude a remote sales agreement for confectionery products via the online store located at:
macaronsmania.ru.
1.2. Placing an order on the website shall constitute acceptance of this offer and confirmation of agreement with its terms.
1.3. The relations between the parties under this agreement shall be governed by the provisions of the Civil Code of the Russian Federation, the Russian Federation Law "On Consumer Rights Protection," and other applicable legal acts.
2. Subject of the Agreement
2.1. The Seller undertakes to transfer ownership of the confectionery products (including macarons, pastries, dessert sets) listed in the online store’s catalog to the Buyer, and the Buyer undertakes to pay for and accept the goods.
2.2. All products are manufactured by the Seller independently (or with the involvement of certified suppliers) and possess the required quality certificates (upon request).
3. Order Placement and Payment
3.1. The order is placed on the Seller’s website by selecting the product and filling out a form with contact details.
3.2. The Buyer shall provide accurate contact and delivery information.
3.3. Payment shall be made via non-cash methods (bank card, payment by details, QR code, etc.). The order is considered confirmed only after payment is received.
4. Delivery and Pickup
4.1. The Seller provides delivery options via courier, third-party delivery services, or self-pickup (at the address specified on the website).
4.2. Delivery times and costs depend on the region and are indicated during checkout.
4.3. If the Buyer is absent at the specified address, the order shall be deemed delivered. Redelivery shall be paid separately.
5. Product Quality and Specifics
5.1. All products are made from fresh ingredients in compliance with sanitary standards.
5.2. Due to the fragility and handmade nature of the products, their appearance may slightly differ from the images displayed.
5.3. Shelf life and storage conditions are indicated on the packaging and/or product page. The Seller shall not be liable for improper storage after transfer to the Buyer.
6. Returns and Exchanges
6.1. Pursuant to Section 4 of the List of Non-Food Goods Not Subject to Return or Exchange (approved by Russian Government Resolution No. 55), returns of confectionery products of proper quality are not permitted.
6.2. In case of defects (e.g., damaged packaging, spoilage before expiration), the Buyer may contact the Seller within 24 hours of receipt, providing photo/video evidence.
7. Liability of the Parties
7.1. The Seller shall not be liable for consequences arising from the Buyer’s improper storage of the goods.
7.2. The Seller shall not be liable for delivery delays caused by courier services.
8. Personal Data
8.1. The Buyer consents to the processing of their personal data (full name, phone number, email, address) solely for order processing, payment, and delivery purposes.
8.2. The Seller shall not disclose personal data to third parties except for delivery services and cases required by law.
9. Miscellaneous
9.1. This offer comes into effect upon publication on the website and remains valid indefinitely.
9.2. The Seller reserves the right to amend the offer, with new terms taking effect upon publication.
9.3. For matters not covered by this offer, the parties shall be guided by the current legislation of the Russian Federation.
